Comprehending Personality Rights: Judicial Approach in India

Abstract

It is a common belief that the two things which are worshipped besides Gods and deities in India are Cricket and Celebrities. The ‘fans’ of these celebrities are blindly influenced by the commercials of the products advertised by their favourite celebrity be it the actor Akshay Kumar in Harpic- Toilet cleaner commercial or cricketer MS Dhoni in the Snickers bar ad. Thus, the level of impact of famous personalities or celebrities on the general public is enormous. Unfortunately, given the wide-scale public attention and huge profits that can be garnered by roping in famous personalities, the instances of misuse of the rights of such famous personalities without their consent for commercial gains has become a common practice nowadays. In this research paper, the authors shall discuss the legal position of Personality/Celebrity Rights in India.
